This study reviews the regulations in force in five European countries
(France, Belgium, the Netherlands, Italy and Germany) and examines how they are
applied in practice. The aim of this analysis is to provide a 'comparative
anatomy' of the regulatory situations in the five selected countries. For each country studied, the plan
adopted distinguishes between the regulatory situation and the methods of
application on the ground, in accordance with the following guideline:
Regulatory situation
- The various types of landfill and material recovery methods
- The status of polluted and depolluted soil
- The procedures laid down in the texts relating to polluted soil or soil
resulting from depollution treatment
- The procedures laid down in the texts relating to the possibilities for
off-site disposal of polluted and depolluted soil
- The procedures laid down in the texts relating to the disposal or material
recovery channels
- The procedures for separating/sampling batches of excavated soil
- The substances and indicators
- The distribution of responsibilities for the application of these
regulations.
Methods of application in the field
- Methods of intervention by the authorities responsible for monitoring
compliance with the regulations
- The practices of the disposal and material recovery industries
- The indicators used by the disposal and material recovery sectors for
polluted soil or soil resulting from remediation treatment
- The methods of intervention in the event of non-compliance with the
regulations
- The most commonly used sectors
